These Terms of Use (“Terms”) govern your access to and use of the Scadex mobile application and the website at scadex.app (together, the “Service”). The Service is operated by [OPERATOR_LEGAL_NAME], registered at the Dutch Chamber of Commerce (KvK) under number [KVK_NUMBER], VAT identification [VAT_NUMBER], with its registered address at [OPERATOR_ADDRESS], the Netherlands (“Scadex,” “we,” “us,” or “our”).
By downloading, installing, or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Scadex is a tool for scanning, identifying, pricing, and grading trading cards. The Service may include AI-assisted features such as automated grade prediction and price estimation. These features are estimates only. They are not professional appraisals and are not a substitute for grading by a recognised third-party service such as PSA, BGS, or CGC. We do not guarantee any specific resale price or grade outcome.
2. Eligibility & account
You must be at least 13 years old (or 16 in the EU) to use Scadex. You may need a Scadex account to access certain features; you agree to provide accurate information when creating one and to keep your credentials confidential. You are responsible for activity that occurs under your account.
3. Subscriptions and auto-renewal
Scadex offers paid subscription plans (such as Scadex Pro and Scadex Business) and one-time purchases (such as Lifetime Pro and scan packs) sold through the Apple App Store or Google Play. The following terms apply specifically to auto-renewable subscriptions:
- Length and price. Subscription length and price are shown to you at point of purchase. Monthly plans renew every month; yearly plans renew every year. Prices may change with notice as described below.
- Free trial. Where a free trial is offered, you can use the Service at no charge for the stated number of days. If you do not cancel before the trial ends, your paid subscription begins automatically at the price shown on the paywall.
- Auto-renewal. Payment will be charged to your Apple ID or Google account at confirmation of purchase. Your subscription automatically renews at the same price unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- How to cancel. You can manage and cancel your subscription at any time in your Apple ID Subscription settings (iOS: Settings → Your name → Subscriptions) or your Google Play subscriptions page (Android). Uninstalling the app does not cancel your subscription.
- Refunds. Refunds for App Store purchases are handled by Apple under Apple's standard refund policy. Refunds for Google Play purchases are handled by Google under Google's policy. Where you are entitled to a refund under EU consumer law (including the 14-day withdrawal right under the Consumer Rights Directive) you may also contact us directly at hello@scadex.app; note that by starting to use the Service immediately you acknowledge that the right of withdrawal lapses as soon as we begin performance of the contract.
- Price changes. If we increase the price of your subscription, we will notify you in advance and you will be given the opportunity to cancel before the new price takes effect.
4. Acceptable use
You agree not to:
- Use the Service to violate any law or the rights of others;
- Reverse-engineer, decompile, or attempt to extract the source code of the App, except to the extent applicable law permits;
- Resell, sublicense, rent, lease, or commercially redistribute the Service or any of its features without our written permission;
- Use automated means (scrapers, bots) to access the Service in a way that materially burdens our infrastructure;
- Upload content that is illegal, infringing, defamatory, or that you do not have the right to upload;
- Attempt to interfere with the security or integrity of the Service.
5. User content
The Service lets you upload images of cards and create vault entries (collectively, “User Content”). You retain all ownership rights in your User Content. By uploading it, you grant Scadex a worldwide, non-exclusive, royalty-free licence to host, process, display, and use the User Content as necessary to provide the Service to you and (where you choose to share) to other users.
You are responsible for your User Content. We may remove content that violates these Terms or applicable law.
6. Intellectual property
The Service, including its software, design, models, and trademarks, is owned by Scadex or its licensors and is protected by intellectual property law. We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on a device that you own or control, for your personal, non-commercial use (or, on Pro / Business plans, for legitimate business use of the plan's features). The Apple-mandated Licensed Application End User License Agreement applies to your installation of the App on Apple-branded devices and is incorporated here by reference.
Pokémon, Magic: The Gathering, Yu-Gi-Oh!, and other card-game names referenced in the Service are the property of their respective owners. Scadex is an independent product and is not endorsed by, affiliated with, or sponsored by any of those owners.
7. Third-party services
The Service integrates with third-party platforms (including Apple, Google, Supabase, RevenueCat, Sentry, Cardmarket, and Scrydex). Your use of those platforms is governed by their own terms. We are not responsible for the availability or accuracy of third-party services or content.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, to the maximum extent allowed by law. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated grades or prices will be accurate.
9. Limitation of liability
To the maximum extent permitted by Dutch law, our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) €50. We are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenues, data, or goodwill.
Nothing in these Terms limits liability that cannot be limited under Dutch consumer law, including liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.
10. Termination
You can stop using the Service at any time and delete your account via Profile → Settings → Account → Delete account in the App. We may suspend or terminate your access if you materially breach these Terms, with notice where reasonably practicable. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated through the App and the “Last updated” date at the top of this page will be revised. Continued use of the Service after a change means you accept the updated Terms. If you disagree, you can stop using the Service and delete your account.
12. Governing law and disputes
These Terms are governed by the laws of the Netherlands. Any dispute arising out of or in connection with these Terms or the Service will be brought before the competent court of Amsterdam, the Netherlands, unless mandatory consumer-protection law gives you the right to bring proceedings in the courts of your country of residence within the EU.
